AOW question need help?

I have a NAA Arms 22mag/22lr. 1 5/8 mini revolver. I would like to purchase this Wallet Holster. But I beleive that this would make my revolver an AOW, and I would have to make it an AOW through my class 3 dealer. Would I buy the holster and bring it and my firearm to my class dealer 3 so he does/file the paper work, Correct? If it is an AOW now, can it still be used as a legal personal self-defense firearm, or as a novelty?

No. Your first step is to acquire the paperwork from the ATF. According to a gentleman who documented his own process on recguns, that would be a Form 1. Fill it out and the fingerprint card out correctly. If you cannot get a Chief Law Enforcement Officer sign-off in your area, you will have to secure an alternative means of ownership: This is usually a corporation or unrevocable family trust, either of which is a legal entity in and of itself and therefore may own a product without being a "living person" and therefore does not require a background check -- and therefore the purpose of the CLEO sign-off is nullified.

Once you have satisfied the Form 1, fingerprints, etc. Send your paperwork and check for 5 bucks off to the ATF (5 dollar tax stamp for AOW, if I recall correctly, as opposed to the 200 dollar tax stamp for SBR, SBS, or suppressor) and wait patiently.

Eventually, you will get your paperwork back with a rather cool tax stamp on it, about 2" x 3" in full color, with engraved scrollwork as intricate as the scrollwork on our money on it.

Once you have that stamped paperwork in hand, THEN AND ONLY THEN are you authorized by the ATF to make your AOW. In which case, you take your NAA revolver, whose serial number is on that paperwork, and do whatever it is you want to do to it that will make it an AOW.

Short answer: Get your paperwork in order first, then make the AOW. Whether you use your local Class 3 dealer to help you fill out your paperwork is your business, but Federally, it is not strictly required.

OTHER REQUIREMENTS VARY STATE TO STATE WHICH MAY MODIFY THE ABOVE INFORMATION. I am NOT a lawyer. I don't even play one on TV. And I didn't stay at a Holiday Inn Express last night.

Call your local ATF if you have questions regarding your paperwork. But ALWAYS ALWAYS ALWAYS have your paperwork in order before making anything authorized by that paperwork.

Now, once you HAVE that paperwork with the tax stamp on it...you can do what the paperwork says you can. Whether it's make an SBR, SBS, Suppressor, or AOW.

Good luck and have fun with your new toy. There is a lot of pride of ownership in making your own Title 2 weapon. There are also a lot of headaches that go with the process.

Finally, it greatly depends upon your STATE law as to whether or not you may use it for defensive purposes. For example, here in Florida, you can carry anything you can legally own -- EXCEPT A MACHINE GUN -- under your Concealed Weapon Or Firearm License...and this has been historically proven to include Title 2 weapons such as SBR's and SBS's.

In other states, even if you can federally own it, you can't legally carry it. And in still other states, you can't even own it.

So whether or not you can use it for defensive purposes depends on STATE law, not Federal law.
